By downloading or using Kyma (the "App"), provided by Oscar Berger ("we", "us"), you agree to these Terms of Use. If you do not agree, do not use the App.
Kyma is a wellness and relaxation product. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or health condition. Heart Rate Variability and related figures shown in the App are wellness indicators, not clinical diagnostics. Always consult a qualified healthcare professional for medical concerns. Do not use the App while driving or operating machinery, and stop use if you feel unwell. If you have a heart condition, epilepsy, or are pregnant, consult a doctor before use.
Kyma offers auto-renewable subscriptions (monthly and annual) and a one-time lifetime purchase. Any introductory offer terms are shown at the point of purchase. Payment is charged to your Apple ID account at confirmation. Auto-renewable subscriptions renew automatically unless canceled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours prior to the end of the period. You can manage or cancel subscriptions in your Apple ID account settings after purchase. Purchases are handled by Apple and are subject to the App Store Terms and Apple's Standard EULA.
We grant you a personal, non-transferable, revocable license to use the App for your own non-commercial use, subject to these Terms and Apple's Standard EULA.
You agree not to reverse engineer, resell, or misuse the App, and to use it in compliance with applicable law.
The App, its audio engine, content, and branding are owned by us or our licensors and are protected by law. No rights are granted except as expressly stated.
The App is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
We may update these Terms; continued use after changes constitutes acceptance.
These Terms are governed by the laws of France, without regard to conflict of law rules.
